The Congress is poised to enact federal legislation called ENDA which would confer a Federal right to non-discriminatory treatment in the workplace upon gay, lesbian, and bisexual employees. There was substantial controversy as to whether the legislation should also cover gender identity discrimination. Many states and localities have enacted such legislation, and the state courts are now beginning to apply and interpret these new statutes. The Federal Courts have issued quite recently conflicting decisions regarding the breadth of the sex stereotyping doctrine and the breadth of Title VII’s prohibition on sex discrimination in the context of gay, lesbian, bisexual and transgender individuals. Our panel will discuss the proposed Federal legislation, the state and local laws in this area, and the developing jurisprudence in both the state and federal courts. Our panel will also address the issues surrounding the utilization of bathroom facilities that has engendered so much controversy.

The program will provide cutting-edge and practical advice for attorneys, human resource professionals and employees. The series Planning Chairs/Moderators also provide a summary of recent employment law developments in the final 30 minutes, including any regulatory developments and groundbreaking opinions. As an interactive seminar, the program affords the opportunity to submit questions for faculty discussion in advance of and during the event.
