Asset Protection Trust Planning
Why Attend?
Asset protection planning is recognized as an important and integral aspect of the estate planning process. No longer is asset protection limited to offshore strategies. Eleven states have now enacted legislation providing creditor protection for self-settled trusts. This timely advanced program is intended for experienced estate planners, tax, and bankruptcy attorneys.
What You Will Learn
Panelists will discuss domestic and foreign legislative developments; challenges against foreign trusts, in the U.S. and offshore; when to use domestic vs. foreign trusts; how to promote the use of discretionary trusts by learning the tools of flexible drafting; tax compliance for offshore trusts; how to use powers of attorney for asset protection; using onshore and offshore insurance products to enhance the asset protection; and a review of the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 and its effect on asset protection trusts, IRA, and homestead exemptions.
