What You Will Learn

The course kicks off with a keynote address by Mathy Stanislaus, EPA Assistant Administrator for Solid Waste and Emergency Response.  It then provides a comprehensive general survey of significant case law developments under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), with focus on remediation, including evolving standards and policies such as vapor intrusion and risk assessment. It also considers new regulatory and enforcement initiatives, including new NPL listings, CERCLA Section 108(b) financial assurance rules for the hardrock mining sector, and the EPA’s policy on hydrolic fracturing under CERCLA. The course then provides an update on the Resource Conservation and Recovery Act (RCRA) by addressing coal combustion wastes, the redefinition of solid waste to address reclaimed and recycled materials, and the EPA’s evaluation of the impact of declining asset values.

In the afternoon, the course turns to enforcement issues, brownfields redevelopment, and renewable energy, including some cutting edge topics such as expedited and subsidized cleanup of and closure of brownfields properties as sites for renewable energy projects. The course wraps up with two roundtable discussions: one features insights from state superfund directors, and the other considers litigation and compliance strategies following Burlington Northern and subsequent case law.

A  networking reception for all in-person registrants and faculty follows. For those needing ethics credit, an optional one-hour lecture on ethical issues in environmental matters is offered over the lunch break. Time is set aside during each presentation to address registrants’ questions.
