In response to the popularity of the Family and Medical Leave Act (FMLA) program in February, 2007— FMLA II provides a timely look at what’s new, recent cases and trends, and updates in the FMLA arena. Topics slated for discussion during FMLA II include:
What’s new in terms of eligibility? 12 months of employment — does it need to be consecutive? 1,250 hours worked—does on-call time count? What if an employee is reinstated with back pay by an arbitrator? Where is the employee’s worksite?
Medical Certification v. Recertification — what’s the difference and does it really matter which one you use? Substitution of accrued paid leave for unpaid FMLA leave only — what happened in Repa, a 7th Circuit Case? Recent cases and trends in employee notice of need for leave.
Issues surrounding bonuses — Production v. Perfect Attendance.
The DOL’s Request for Information — employer coalition and employee advocacy comments.
The waiver issue revisited — Dougherty v. Teva.
