What You Will Learn

In the past two terms of the Supreme Court, the Court in the school arena has addressed the legality of affirmative action and diversity plans. During the past few years, the Courts of Appeal have issued a significant number of decisions regarding the legality of affirmative action and diversity plans in the workplace. Our panel will articulate their respective views regarding what might remain legal under the anti-discrimination laws and the Constitution in terms of workplace affirmative action and diversity programs. We will attempt to determine from our ideologically diverse faculty whether there is any consensus as to what is clearly legal and what clearly crosses the line.

Our audience can anticipate a stimulating debate regarding these issues, with a view to alerting the audience to any safe harbors and to where the minefields lay. As an interactive seminar, the program affords the opportunity to submit questions for faculty discussion in advance of and during the event.
