Federal False Claims Act:
Important Amendments Under the Fraud Enforcement & Recovery Act of 2009
Why Attend?
The Fraud Enforcement & Recovery Act (FERA), signed into law by President Obama on May 20, 2009, includes the most comprehensive amendments to the civil False Claims Act (FCA) and its qui tam whistleblower provisions since 1986. The FCA amendments will broadly impact Department of Justice enforcement initiatives for all industry sectors and expand the scope of FCA cases brought under its qui tam provisions by private citizens. Learn how these new amendments will impact government investigations and litigation brought under the FCA form a panel of nationally recognized False Claims Act practitioners.
Our panel of False Claims Act practitioners will present the defense and relator (whistleblower) perspectives for a two hour video webcast that can be viewed at your office or home. As a registrant, you will receive automatic complimentary on-line access to the seminar archives. Ask the panel your questions via email during the broadcast on July 14th.
Key Issues to be discussed include:
New definition of claim and materiality standard
New overpayment liability under amended reverse false claim provisions
Expanded conspiracy provision
Potential pitfalls for expanded liability for the health industry
Application of FCA to TARP and federal stimulus packages
Procedural changes in qui tam cases relating to statute of limitations and retroactivity
Enhanced provisions to encourage use of Civil Investigative Demands
Expanded retaliation liability for contractors and agents
Expected legal challenges and defenses to amendments
Forecast of additional amendments to FCA in the legislative pipeline
